Employee exits represent one of the most sensitive and legally exposed points in the employment lifecycle. Whether arising from performance issues, workplace conflict, restructures or relationship breakdowns, the way an exit is managed can have far-reaching consequences for legal risk, employee relations and organisational reputation. Settlement agreements can be a powerful risk-management tool when used correctly. However, when relied upon without a sound underlying process, they can create rather than mitigate exposure. In an environment of increasing scrutiny around employer decision-making, documentation and procedural fairness, organisations must be confident that their exit processes are legally robust, commercially proportionate and handled with professionalism throughout. With Employment Rights reforms on the horizon and growing focus on confidentiality clauses and exit conversations, traditional approaches to settlement agreements are no longer enough. Settlement terms may not offer the protections they once did, particularly in cases involving discrimination, harassment or victimisation. Exit risk is evolving – and processes that fail to adapt risk leaving employers exposed.
