1. About these terms

These terms apply to your use of Near Here at https://nearhere.events. By using the site, you agree to these terms.

Near Here is a trading name of Furls Digital Ltd, a company registered in England and Wales (company number 17110533). Registered office: Belmont Suite Paragon Business Park, Chorley New Road, Bolton, Lancashire, England, BL6 6HG. VAT registration number: 519 9802 54.

2. What this service is

Near Here is an events discovery and aggregation service. We are not the organiser of listed events, and we do not sell tickets or take bookings for third-party events unless explicitly stated otherwise.

The service is intended for users in the United Kingdom. Listed events are based in the UK. We do not target users outside the UK, and we do not guarantee the service complies with non-UK laws.

3. Event information and verification

Event details are sourced from third-party websites, listings, and organisers. We aim to be accurate, but we cannot guarantee that any listing is complete, current, or correct.

Dates, times, locations, accessibility details, availability, and prices can change or be cancelled at short notice. You must verify key details directly with the organiser or venue before travelling or spending money.

You are responsible for assessing whether any listed event is safe, suitable, age-appropriate, accessible, or otherwise right for you and anyone in your care, including any health, supervision, transport, parking, insurance, safeguarding, licensing, or other practical requirements. Near Here does not perform background checks on organisers, venues, instructors, attendees, or third-party providers.

Inclusion of an event, venue, organiser, group, business, charity, council, school, club, place of worship, or other third party on Near Here does not mean we endorse, recommend, sponsor, verify, audit, or are affiliated with them. Listings are aggregated for discovery only and are not professional, medical, legal, financial, childcare, safeguarding, travel, or safety advice.

Organisers and venues are responsible for ensuring their event information is accurate, lawful, current, and not misleading, and that their events comply with applicable laws, permissions, licences, insurance, safeguarding, health and safety, accessibility, ticketing, refund, and consumer protection obligations.

4. Pricing information

Any pricing shown on Near Here is indicative only unless we clearly state it has been officially confirmed by the organiser. The organiser or ticketing provider is the authoritative source for final pricing and terms.

5. Third-party websites and content

We link to third-party websites for official event information. We do not control those sites and are not responsible for their content, policies, availability, or transactions.

If you believe a listing is inaccurate, infringes intellectual property rights, or should be removed for another reason, please contact hello@nearhere.events with the URL of the listing and the reason. We aim to review valid takedown or correction requests within a reasonable timeframe.

6. Affiliate links and commissions

Some links on Near Here are affiliate links. If you click through and make a booking or purchase, we may earn a small commission from the provider at no extra cost to you.

Where affiliate arrangements apply, we aim to make that clear on the relevant page or link area. Affiliate relationships do not change our aim of showing useful local events, and they do not increase the price you pay.

7. Sponsored content and advertising

Near Heremay include paid advertising, sponsored listings, promoted placements, sponsored newsletter sections, or other commercial partner content. Where content is paid for or influenced by a commercial arrangement, we will make that clear close to the relevant content. Paid event boosts are labelled "Ad". Editorial boosts chosen and funded by Near Here are labelled "Boosted by Near Here" and are not paid placements.

Paid placement may affect where or how sponsored content is shown, but it does not make us the organiser, seller, or provider of the advertised event, venue, product, or service unless we explicitly say otherwise.

Sponsors and advertisers are responsible for the accuracy, lawfulness, availability, pricing, offer terms, and claims in their own advertising or sponsored material. You should check important details directly with the sponsor, organiser, venue, or seller before travelling, booking, buying, or relying on an offer.

8. Event boosts

If you buy or fund an event boost, you are buying a time-limited and area-limited visibility placement for an existing event onNear Here. A boost helps the event appear more prominently for the Near Here areas and weeks selected at checkout.

A boost is not a ticket, event booking, seat reservation, entry payment, donation to the organiser, or payment for the organiser's own services. We do not become the organiser or ticketing provider for the boosted event.

We do not guarantee a particular number of views, clicks, newsletter opens, attendees, sales, donations, or other outcomes from a boost. Actual visibility depends on normal site and newsletter traffic, user behaviour, caching, delivery, and service availability.

Boost prices are shown before checkout and include VAT. Checkout accepts card payment. Payments and card receipts are handled by our payment provider, and Near Here sends a separate booking confirmation.

You can request a VAT invoice before payment. Our payment provider will collect the billing details needed for it and send it separately. If you need an invoice after payment, contact us from the email address used at checkout and include the boost reference; we may need to ask for the customer or business name, billing address, and VAT number to prepare it.

You can ask to cancel a boost by replying to its Near Here booking confirmation or by contacting us from the email address used at checkout. Please include the boost reference so we can find the right purchase without asking for unnecessary personal information.

Consumers normally have until the end of the 14th day after the boost contract is made to cancel it without giving a reason. If you ask us to start a boost during that period and later cancel it before it has finished, we may deduct a proportionate amount for the part already provided. Once the boost has been provided in full, the statutory cancellation right ends where you gave the required request and acknowledgement at checkout. This does not affect any other statutory rights you may have.

Cancelling a boost stops its remaining placement where reasonably possible but does not remove its historic delivery records. Any refund depends on when the boost started, how much of it has already run, and any rights that apply by law.

Where a refund is due following cancellation, we will issue it within 14 days of being told that you are cancelling, using the original payment method and without a refund fee. Your bank may take a little longer to show it.

You do not have to use a particular form to cancel. If useful, this is the standard cancellation form: "To Furls Digital Ltd, Belmont Suite Paragon Business Park, Chorley New Road, Bolton, Lancashire, England, BL6 6HG, hello@nearhere.events: I give notice that I cancel my Near Here boost. Boost reference and purchase date: [reference and date]. Consumer name and address: [your name and address]. Date: [date]." Email it to hello@nearhere.events. We will acknowledge your cancellation by email.

We will provide boosts with reasonable care and skill. Nothing in these terms limits the rights consumers have under the Consumer Rights Act 2015 or other rights that cannot lawfully be limited.

We may refuse or end a boost if the event is removed, materially inaccurate, unsuitable for promotion, the subject of a credible complaint, or cannot safely be promoted for an operational or legal reason. If we do this for a reason that is not your fault, we will cancel the remaining placement and give an appropriate refund for any part of the paid boost we did not provide. If none of the paid boost was provided, that will be a full refund. This does not limit any statutory remedy you may have.

9. Acceptable use

You agree not to misuse the site, including by introducing malicious code, attempting unauthorised access, or interfering with service availability.

Except as permitted by applicable law or with our prior written permission, you must not copy, extract, crawl, scrape, harvest, reproduce, republish, mirror, redistribute, train machine learning models on, or bulk-download content from Near Here, and you must not use Near Here content to build, populate, or maintain a competing database, directory, or events product. This restriction applies to our original platform content, the selection and arrangement of listings, our database compilation, and any other material in which we hold rights, and is without prejudice to any rights third parties hold in their own underlying content.

The site is not directed at children under 13. If you are under 13, please use the site or the newsletter only with the involvement of a parent or guardian.

10. User submissions

If you submit a venue suggestion, correction, takedown request, event tip, or other content to Near Here(whether by form, email, or any other channel), you confirm that you have the right to do so and that the content does not infringe any third party's rights or applicable law.

You grant Furls Digital Ltd a worldwide, royalty-free, non-exclusive licence to use, reproduce, edit, adapt, moderate, publish, display, and distribute the content for the purpose of operating, improving, and promoting Near Here. This licence continues for as long as is reasonably needed to run the service and to keep records of when and how the submission was made.

We may moderate, edit, decline, suspend, or remove any submission at our discretion, including where we believe it is inaccurate, unlawful, misleading, infringing, abusive, or otherwise unsuitable for the service.

11. Intellectual property

The platform design, code, branding, and original content on Near Herebelong to us or our licensors. Third-party event text, logos, and media remain the property of their respective owners.

12. Service availability and changes

We may update, suspend, or remove free features at any time. We do not guarantee uninterrupted or error-free availability. If a change or outage prevents us supplying a paid boost as agreed, your statutory remedies and the boost cancellation and refund terms above still apply.

We are not liable for delays, failures, or unavailability caused by events outside our reasonable control, including network or infrastructure outages, third-party provider failures, regulatory action, cyber-attacks, or extreme weather.

13. Location features

If you choose to use location-based features, we may use approximate IP-based location to keep the site working and, if you accept cookies, remember a more precise location preference for future visits. You can manage this through your browser settings and our cookie controls.

14. Newsletter emails

If you sign up for our newsletter, you are asking us to send local event emails to the address you provide for the location you select. That includes the confirmation and management emails needed to run the subscription, and the regular local-event digest once you have confirmed. Each newsletter email includes unsubscribe and management options.

Newsletter emails may include clearly labelled advertising, sponsored placements, or commercial partner messages relevant to local events, venues, or services.

We may limit, suspend, or stop newsletter sending where we receive bounce or complaint signals, where we believe the service is being misused, or where continued sending would create a deliverability or compliance risk.

Newsletter emails are still subject to the event-information limitations in these terms. Organisers and venues remain the authoritative source for the final details, so you should always check the host's website before travelling, booking, or spending money.

Our Privacy Policy explains how we handle newsletter personal data and your rights in relation to those emails.

15. Warranties and liability

The free event-discovery service is provided on an "as available" basis. To the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from use of the free service or reliance on third-party event listings. This does not reduce the standards or remedies that apply to a paid boost.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

You agree to compensate us for reasonable losses, costs, or claims we suffer arising from your misuse of the service or breach of these terms. This does not affect any rights you have under consumer protection law that cannot be excluded.

16. Consumer rights and dispute resolution

If you are a consumer, you have legal rights under applicable consumer law. These terms do not reduce or remove rights that cannot be excluded by law.

We aim to resolve any complaint quickly through hello@nearhere.events. If we cannot resolve a complaint between us, you can find information about complaining to public services or about consumer rights through Citizens Advice at citizensadvice.org.uk or your local Trading Standards office.

17. Breach and enforcement

We may restrict or terminate access where we reasonably believe these terms have been breached or the service is being misused.

18. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts as permitted by law.

19. Changes to these terms

We may update these terms from time to time. We will update the "Last updated" date at the top of this page when changes are made. For material changes that affect your rights, we will also post a notice on the site and, where reasonable, notify newsletter subscribers by email. Changes will not retrospectively alter a boost you have already bought unless the law requires the change or you agree to it.

20. General

If any part of these terms is found unenforceable, the rest remains in force. Any delay in enforcing rights is not a waiver of those rights.
